Terms and Conditions (T&C)
retter.ch GmbH


1. Scope of Application
These Terms and Conditions (T&C) apply to all business relationships between retter.ch GmbH, Switzerland (hereinafter “Provider”) and its customers.
They apply in particular to the sale and rental of evacuation and rescue systems as well as related accessories.
Any deviating terms and conditions of the customer shall only be recognized if they have been expressly agreed upon in writing.


2. Offer and Conclusion of Contract
Offers made by the Provider are subject to change and non-binding.
A contract is concluded through:

written order confirmation

delivery of the goods

or express acceptance by the Provider

 

3. Prices and Terms of Payment
All prices are quoted in Swiss Francs (CHF), unless otherwise stated.
The Provider reserves the right to adjust prices at any time.
Invoices are payable in full within the agreed period.
In the event of late payment, the Provider may charge late payment interest and reminder fees.


4. Delivery and Shipping
Delivery dates are non-binding unless expressly confirmed in writing.
Partial deliveries are permitted.
Title and risk pass to the customer upon shipment of the goods.


5. Inspection and Notification of Defects
The customer must inspect the goods immediately upon receipt.
Defects must be reported in writing within 5 business days.
If notification is not provided within the specified time, the delivery is deemed accepted.

 

6. Warranty
The Provider warrants that the products are free from defects in materials and workmanship at the time of delivery.
In the event of a defect, the Provider may, at its discretion:

Repair the product

Provide a replacement

Further claims are excluded to the extent permitted by law.


7. Product Safety and Use
The respective safety and usage instructions apply to the use of the products.
The Light version may also be used by untrained persons, but requires proper use.
Responsibility for the specific use lies with the user.

8. Liability
The Provider’s liability is governed by applicable law.
To the extent permitted by law, liability is excluded for damages resulting from:

improper use

use outside the intended scope of application

failure to follow instructions for use

unauthorized modifications to the product

Liability for slight negligence is excluded.
Mandatory statutory provisions, in particular under product liability law, remain reserved.

The rescue sling is generally used in emergency and rescue situations where the affected person is already in danger.

The decision regarding the type of rescue and the use of the product is the responsibility of the person(s) taking action.

In particular, it cannot be ruled out that transporting an injured person—for example, in cases of existing back injuries or multiple injuries—may result in additional complications.

The rescue sling is designed as an aid to facilitate evacuation under difficult conditions; however, it does not replace a medical assessment or professional rescue by trained personnel.

retter.ch GmbH is not liable for damages resulting from the specific execution of a rescue operation, provided that the product was used properly and there is no product defect.

9. Rental (if applicable)
The following additional terms apply to rentals:

The rental item must be treated with care

Any damage must be reported immediately

The renter is liable for any damage that occurs during the rental period

The item must be returned in its original condition (taking into account normal wear and tear)

10. Retention of Title
The delivered goods remain the property of retter.ch GmbH until full payment has been made.


11. Export and International Use
The customer is responsible for complying with all applicable import, export, and usage regulations.


12. Data Protection
The provider’s separate privacy policy applies.


13. Jurisdiction and Applicable Law
Swiss law applies exclusively.
The place of jurisdiction is the registered office of retter.ch GmbH, unless mandatory statutory provisions provide otherwise.


14. Final Provisions
Should individual provisions of these Terms and Conditions be invalid, the validity of the remaining provisions remains unaffected.
